(梁勇律师事务所，lianglaw.com专稿)”公共负担“是美国移民法中作为禁止非移民入境及递解出境的原因之一，这项法律在美国的移民法中已经有一百多年的历史。一个非公民的人士只要在任何时候可能成为“公共负担”者，都可能因此而不能入境美国或调整身份为为永久居民，或有被递解出境的危险。

在一般而言，不作为维持收入的非现金福利不属于“公共负担”的考虑范围，这些项目包括了：

• 公共医疗补助及接种疫苗: Medicaid and other health insurance and health services (including public assistance for immunizations and for testing and treatment of symptoms of communicable diseases, use of health clinics, short-term rehabilitation services, prenatal care, and emergency medical services) other than support for long-term institutional care
• 儿童健康保险计划(CHIP)Children's Health Insurance Program (CHIP)
• 食品券、妇女、婴儿和儿童营养特别补助计划(WIC):Nutrition programs, including Food Stamps, the Special Supplemental Nutrition Program for Women, Infants and Children (WIC), the National School Lunch and School Breakfast Program, and other supplementary and emergency food assistance programs
• 住房补助:Housing benefits
• 育幼服务:Child care services
• 能源补助：Energy assistance, such as the Low Income Home Energy Assistance Program (LIHEAP)
• 紧急灾难援助:Emergency disaster relief
• 寄养与领养援助:Foster care and adoption assistance
• 教育补助:Educational assistance (such as attending public school), including benefits under the Head Start Act and aid for elementary, secondary, or higher education
• 工作培训计划：Job training programs
• 紧急避难及援助服务：In-kind, community-based programs, services, or assistance (such as soup kitchens, crisis counseling and intervention, and short-term shelter)
• 非现金临时家庭援助：Non cash benefits under Temporary Assistance for Needy Families (TANF) program TANF such as subsidized child care or transit subsidies
• 特定社会福利及政府养老金、退伍军人福利等：Cash payments that have been earned, such as Title II Social Security benefits, government pensions, and veterans' benefits, among other forms of earned benefits, do not support a public charge determination.
• 失业救济金：Unemployment compensation is also not considered for public charge purposes ** 小心， 如果你是H-1B，L-1，..等短期非移民工作身分或I-485 等待调整绿卡身分，最好与你的移民律师讨论失业救济金这一部分的申请。

上述由于这些福利并不是以维持收入而目的，而是要帮助解决“紧急”事件，所以虽然有些是以“现金” 的方式取得，仍不列入“公共负担”的考虑范围之内。

然而，一个非公民人士并不会单纯因为接受现金援助来维持收入，或长期住院接受医疗照顾而使得因“公共负担”而不得入境美国，失去调整身份的权利，或因此而递解出境。在申请入境身整身份时，移民局及国务院仍必须考虑申请人的其他因素包括：年龄、健康情况、家庭状况、财产、独立能力、财务状况、教育及工作能力等来作为评估的考虑，除非申请人无法取得经济担保书外，移民局及国务院是不会以单一的原因来决定某个外籍人士是否是美国的“公共负担”。

除非现金补助是维持非公民全家生活的唯一来源，否则一个家庭的某个成员取得补助不会因为“公共负担”的原因而影响到一个家庭的其他成员。所以我们提醒非公民及其家属不要因此而拒绝自已本来可以享受的福利，而影响了政府扩大健康保险的范围及帮助人民度过接受公共援助的过渡时期而能自食其力的美意。
